Surrogacy is a complicated process with many parties involved. Continue below to learn the answers to some of the most frequently asked questions.
Who is eligible for surrogacy in Mexico?
Anyone. The Mexican constitution does not allow for discrimination based on citizenship, marital status, or sexual orientation. The Supreme Court reaffirmed this in their 2021 ruling.
Do I have legal representation throughout the process?
Yes, your legal team will assist in the drafting of the surrogacy agreement with your surrogate mother and with the acquisition of the birth certificate at the end of the process. Additionally, they will assist you in acquiring any documents necessary to apply to your embassy for citizenship. It is important to remember that they are experts in Mexican law, they cannot advise on specific laws related to your country of citizenship, and you may need legal representation as well in your home country.
Do I have to meet any requirements to be accepted to the program?
Yes, you and your partner, if applicable, must provide a recent background check and undertake a psycho-social evaluation to be eligible to participate, the same as we expect from your surrogate.
Where should I stay on my first visit?
You may choose to stay anywhere in Mexico City, but the most convenient location may be in the are of Polanco where the clinic is located.
Is gender selection possible in Mexico?
Pre-Implantation Genetic Testing (PGT) is an option, but it does come with additional cost and wait time for results. Results typically take 2 weeks after embryo creation.
Is egg splitting with the implantation of a genetically related embryo from 2 different male partners possible?
It is possible to egg split (create embryos using 2 sperm sources with the same egg retrieval), but only embryos from a single intended parent will be implanted to a surrogate mother.
What happens if there is a failed attempt?
If there are additional frozen embryos for transfer, a new transfer can often be conducted within a month or two to the same surrogate mother. If there are no more embryos, an additional cycle will need to be conducted to produce more embryos. Additional costs may apply depending on the program chosen.
Where will the birth take place?
This may vary based on the location of the surrogate mother, but it will be in one of the hospitals in Mexico City. Our preferred birth hospital is across from the clinic, Hospital Espanol.
Is the baby eligible for Mexican citizenship?
Yes, but acquiring a Mexican passport is not something we recommend or can assist with. It can create a bureaucratic process that can lead to extremely long delays, so we cannot recommend it.
Can 2 men or 2 women be on the birth certificate?
As it currently stands, no. There is precedent, but, like above, it may lead to an extremely long court process,
What is the average exit time after birth?
Intended parents should always allow for flexibility at birth as each process is unique. The average time in Mexico will be 3 – 6 weeks and will depend on your country of citizenship and time your embassy takes to process your baby’s citizenship and passport.
Is Mexico City safe?
Like all cities, Mexico City has good and bad areas. We are located in the area of Polanco which is the most international friendly and safest part of Mexico City. There are many high-end hotel brands, shops, and restaurants in this area, so you ca feel very comfortable. Many of the embassies are also located in or near near Polanco.
What tests are conducted on egg donors?
Donors undergo psychological screening as well as testing for ovarian reserve and screening prior to donation for HIV, hepatitis, gonorrhea, syphilis, and chlamydia.
Can we use a known egg donor?
Only anonymous donation is allowed in Mexico. If you have your own donor from abroad, it may be possible.
What testing is conducted on surrogate mothers?
Similar to egg donors, they undergo psychological screening, infectious disease screening, and an additional uterine cavity evaluation before embryo transfer.
How can we be sure that our surrogate is taking proper care of herself and the baby?
In addition to frequent medical visits and with a psychologist during the process, a social worker will also visit your surrogate’s dwelling during the process.
Do we communicate with our surrogate throughout the process?
We can facilitate 3-way video conferences in each trimester with a member of our team so you can build a close bond.
How many attempts will our surrogate mother agree to undertake?
Typically surrogates agree for up to 3 embryo transfers and then a new match will be made.
I am an HIV+ male, is surrogacy possible?
Sperm washing is possible with an outside specialized lab. It has additional costs, and typically surrogates will ask for additional fees to match which is their right.
What are the success rates?
Every case is different and depends on the particular circumstances of the case. If it is IVF with one’s own eggs, age plays a major role. The highest success rates tend to occur with egg donor cases. Success rates with normal sperm, egg donation, and surrogacy can be as high as 75% per attempt.
What prenatal monitoring is conducted during the pregnancy?
A beta HCG test is conducted approximately two weeks after embryo transfer. If the test is positive, a second test is conducted two – three days later to measure hormone levels. A confirmation ultrasound is conducted at approximately week 7 of gestation if tests are still positive. A dual screen is conducted at week 12 to check for chromosomal abnormalities of the fetus as well as an anatomy scan around week 20. Ultrasounds will typically be conducted monthly throughout the pregnancy.
Who will be represented on the birth certificate?
If a heterosexual couple, the intended mother and father, if a single man or same sex male couple, the biological father will be on the birth certificate..
