Surrogacy is a type of third party reproduction and the act of a woman carrying a baby for different intended parents. A woman giving this great gift is called a surrogate, surrogate mother, or gestational carrier. Surrogacy is often the only way to achieve parenthood in a number of situations. These include medical issues such as recurrent miscarriage or a loss of uterus (hysterectomy). Surrogacy is also the only way to procreate for single men and gay men who have no female partner.
Prior to 2016, the state of Tabasco in southern Mexico was a leading global destination for surrogacy. In 2016, with Decree 233, surrogacy was banned for all except Mexican heterosexual married couples. This largely brought legal and regulated surrogacy to an end in Mexico. At the time, our legal team was one of the ones to fight the prohibition as unconstitutional. In June, 2021, the Supreme Court of Mexico ruled just that, that discrimination against foreigners and different family types was indeed unconstitutional. This ruling from the highest court in the land forms the basis for legal surrogacy in Mexico.

Egg donation is another form of third party assisted reproduction. The ova, or eggs, of a third party female are retrieved and inseminated with sperm to create embryos for transfer. Situations such as low ovarian reserve due to premature ovarian failure or advanced maternal age-may necessitate egg donation. Single males and same-sex male couples will also need an egg donor in addition to a surrogate mother.
